Can I Bring Marijuana from Colorado to Texas?

Texas, like Arizona and Florida, has some of the harshest drug laws in the nation and for good reason. Due to our geographic location, we have a significant problem with drugs being trafficked in from Mexico. But our tough drug laws aren’t enough to stop Texans from driving to Colorado and driving back with marijuana and various edibles.

A lot of people travel to Colorado, where they can buy marijuana legally, and they take it back with them to Texas, where they cannot buy it legally. But is this practice legal? It may be legal for someone to buy marijuana and edibles in Colorado, but it’s NOT legal to possess it in Texas.

Marijuana Still Illegal in Texas

“Despite countless warnings on websites by Texas criminal defense lawyers about the danger of hauling back innocent-looking gummy bears, cookies or chocolates, countless Texans are loading up on marijuana extracts in Colorado, where they’re legal, and heading cross country into Texas and the waiting arms of law enforcement,” Christian McPhate wrote in the Dallas Observer.

If you’re even thinking about driving to Colorado to buy marijuana or edibles and bringing them back to Texas, you want to think again. If you’re caught, you can face serious criminal charges and sentencing. Even being caught with one pot-infused gummy bear can result in 180 days in jail and up to a $2,000 fine if it’s under two ounces.

Possession of Marijuana in Texas

  • 2 ounces or less is a misdemeanor, punishable by 180 days in jail and a maximum fine of $2,000.
  • 2 to 4 ounces is a misdemeanor, punishable by 1 year in jail and a fine not to exceed $4,000.
  • 4 ounces to 5 pounds is a felony offense, punishable by 180 days to 2 years in jail and by a fine not to exceed $10,000.
