Social Security rules allow for a maximum of 12 months of retroactive benefits. There are, however, a few exceptions to the 2 year waiting period. Those claimants with end stage renal disease kidney failure and those who require ongoing dialysis or a kidney transplant can receive Medicare benefits in the 3rd month after their dialysis began. Also, those who suffer from amyotrophic lateral sclerosis (ALS) can also collect Medicare benefits as soon as they are eligible.
