CDL DWI

CDL DWI Defense Lawyers in Plano

Have You Been Charged With CDL DWI?

Commercial driver’s licenses (CDL) have a specific set of legal restrictions when it comes to driving while intoxicated. The restrictions are due to an increased risk to the community of various types of dangerous cargo and other factors, as some may create a hazard to the citizens of the area. One of the restrictions of a CDL is the blood alcohol concentration that is legally allowed to the driver.

If you have a BAC of over 0.04%, you have exceeded the allowable concentration for a CDL vehicle operator. If you are flagged down and checked for suspicion of DWI with a CDL and are found to have exceeded 0.04% BAC, you will be arrested.

What Are The Consequences?

An arrest for a CDL DWI in Texas is a very serious matter. You may have your license suspended for up to one year. Not only is this true if you receive a DWI while operating a commercial vehicle, but if you are driving another vehicle, (such as your own car) and you are arrested for having a BAC level of over 0.08%, you can potentially lose the ability to operate a commercial vehicle for up to a year.

Per Texas Code §522.081, the following will result in a 1 year CDL suspension:

“Refusing to submit to a test under Chapter 724 to determine the person’s alcohol concentration or the presence in the person’s body of a controlled substance or drug while operating a motor vehicle in a public place”

Are You At Risk Of Losing Your CDL In Plano?

If you have a CDL, a DWI could cost you your livelihood. At the Zen Law Firm, we have the practical experience, knowledge, and skill to help you get the favorable case outcome you need. Commercial drivers are forced to adhere to stricter DWI laws, so the potential consequences are equally as severe. They can apply to have it reinstated after 10 years have elapsed, but the ability to earn a living during that time might pose serious problems for anyone relying on this line of work to support themselves or their family.

The DWI laws in Texas are strict for the holders of commercial driver’s licenses. If you are facing the grim prospect of being unable to work due to a CDL DWI, you should not hesitate to enlist the help of qualified legal representation. Our criminal defense team is capable and familiar with CDL DWI charges and will work to assist you to maximize your chances of being allowed to continue to work and drive.
