The Constitutionality Of Sobriety Checkpoints

Sobriety checkpoints are roadblocks in which law enforcement officials look for impaired drivers, often instituted during various holidays or in areas in which there are many bars or nightclubs. While these checkpoints may seem like a good idea to keep the general public safe, they are, in fact, unconstitutional and illegal in the state of Texas. These checkpoints violate Fourth Amendment rights that prohibit pulling someone over without reasonable cause.
